SCOPE OF THE GENERAL TERMS AND CONDITIONS
These General Terms and Conditions (“GTC”) contain the general terms and conditions governing the use of the online ordering platform operated by BERRIVIT Limited Liability Company as the Service Provider, as well as the sale of products available for purchase through said platform.
Please use our services only if you agree with all provisions of these GTC and consider them binding upon you.
This document is concluded exclusively in electronic form, does not constitute a written contract, and does not refer to a code of conduct.
The language of the contract is Hungarian.
1.1 Products sold on the website operated by the Service Provider may be purchased exclusively through online orders.
1.2 By purchasing the products, the Customer accepts the terms and conditions of these GTC.
1.3 These Terms and Conditions are effective as of the date of publication and remain in force until revoked.
1.4 The Service Provider’s primary business activity: 4727 Other food retail.
1.5 The Service Provider sells fruit concentrates and other fruit products to consumers and businesses via an online ordering channel.
2.1 The Service Provider conducts its data processing activities in accordance with applicable laws—in particular Regulation (EU) 2016/679 (GDPR), Act CXII of 2011 on the Right to Self-Determination in Information and Freedom of Information (Infotv.), and Act CVIII of 2001 on Electronic Commerce Services (Ekertv.).

3. RANGE OF PRODUCTS AVAILABLE FOR PURCHASE
3.1 The prices of the products displayed on the website include all taxes required by law and are listed in Hungarian forints (HUF).
3.2 The prices listed do not include shipping costs, unless the Service Provider expressly agrees to cover shipping costs for orders exceeding the amount specified on the online ordering interface. The Service Provider does not charge a separate packaging fee.
3.3 The Service Provider displays the name, description, and photograph of the products on the website. The images displayed on the product data sheets are, in certain cases, for illustrative purposes only and may differ from the actual product.
3.4 The Service Provider reserves the right to unilaterally modify prices. Price changes apply to orders placed after the modification is published.
3.5 The products are classified as food products. Information regarding ingredients, allergens, and storage conditions is included in the product descriptions.
4.1 The Customer may place an order by completing and submitting the online order form. On the form, the Customer may specify the quantity of the product(s) or product bundles to be ordered, the shipping address, and the preferred delivery time.
4.2 Steps in the ordering process:
a) The Customer selects the desired products and provides the order details.
b) The Customer fills out and submits the online order form.
c) Upon receipt of the order, the Service Provider confirms the order via email.
d) The confirmation includes: the name and quantity of the ordered product(s), the unit price, any applicable shipping fee, the total amount due, and the electronic invoice.
4.3 If the confirmation email is not received by the Customer within 48 hours, the Customer is released from the obligation to accept the offer, and the order shall not be deemed to have been concluded.
4.4 The Customer agrees that a contract concluded in this manner constitutes an electronic contract governed by Hungarian law. The provisions of these GTC apply to the contract.
4.5 The Service Provider reserves the right to reject orders without providing a reason, particularly if the order details are incomplete or inaccurate, or if the requested product is unavailable.
5.1 Payment for products and services may be made in the following ways:
a) Online credit card payment (via the Simple Pay payment service provider).
b) Bank transfer.
5.2 In the case of online credit card payments, credit card data is processed by OTP Mobil Kft. (1093 Budapest, Közraktár u. 30-32.); the Service Provider does not have access to credit card data. The customer acknowledges that their personal data stored by the data controller BERRIVIT Limited Liability Company (name, email address, billing address) will be transferred to OTP Mobil Kft. as the data processor. 5.3 In the case of a bank transfer, the payment deadline is 5 business days from receipt of the electronic invoice, unless the Parties agree otherwise.
5.4 The Service Provider issues an electronic invoice, which is sent to the Customer along with the confirmation email.
6. DELIVERY TERMS AND DEADLINES
6.1 Upon receipt of an order, the Service Provider will deliver the products primarily via the parcel logistics provider GLS to the delivery address provided at the time of ordering. The Service Provider also offers scheduled delivery routes in certain regions.
6.2 Route delivery schedule (valid only within Hungary – for informational purposes only; monthly variations are possible due to holidays; for the exact date, please inquire at berrivit@gmail.com):
– Budapest and its suburbs: every two weeks, on Tuesdays
– Southeastern region (Great Plain): the first Thursday of the month
– Northeastern region: the second Thursday of the month
– Central and Western Transdanubia: the third Thursday of the month
– Southern Transdanubia: the fourth Thursday of the month
6.3 Round-trip delivery is not available for all orders and is not considered a time-sensitive service.
6.4 The delivery time is for informational purposes only. The Service Provider assumes no liability for delays caused by the delivery partner.
6.5 The Service Provider shall not be held liable for delays or other delivery issues attributable to incorrect, incomplete, or inaccurate delivery information provided.
6.6 The shipping fee is displayed on the online ordering interface. The web store will inform the Customer of the currently valid threshold for free shipping.
7.1 A Customer who qualifies as a consumer is entitled to withdraw from the contract without giving any reason within 14 days of receiving the ordered product, in accordance with the provisions of Government Decree No. 45/2014 (II. 26.).
7.2 For health and hygiene reasons, the Customer is not entitled to the right of withdrawal for a product that has been opened after receipt. The Service Provider will not accept returns of products with damaged or opened packaging.
7.3 The Customer is obligated to check the integrity of the product’s packaging upon receipt. If the Customer notices visible damage, they are entitled to refuse acceptance; in this case, they may withdraw from the contract or request that the product be redelivered.
7.4 The Buyer may exercise the right of withdrawal by means of a clear written statement—sent via email to the address berrivit@gmail.com.
7.5 The right of withdrawal shall be deemed to have been exercised within the time limit if the Buyer sends their statement before the expiration of the time limit specified in Section 7.1.
7.6 The Buyer bears the burden of proving the proper exercise of the right of withdrawal.
7.7 In the event of a lawful withdrawal, the Customer is required to return the product—in its original, new condition, with undamaged packaging, and complete—to the Service Provider or to the sender indicated on the GLS shipping label within 14 days at the latest.
7.8 The direct cost of returning the product shall be borne by the Customer.
7.9 The Service Provider shall refund the amount paid to the Customer within 14 days of receiving the returned product, using the same payment method used at the time of purchase. The Service Provider may withhold the refund until it has received the product or until the Customer has provided credible proof of the return.
8. WARRANTY OF FITNESS FOR PURPOSE AND PRODUCT WARRANTY
8.1 In accordance with the provisions of Act V of 2013 on the Civil Code (Civil Code), the Service Provider is liable under the warranty of fitness for purpose in the event of defective performance.
8.2 In the event of a claim under the warranty for defects, the Customer may, at their discretion, assert the following claims:
a) Request repair or replacement, unless the fulfillment of the chosen warranty claim is impossible, or if it would result in disproportionate additional costs for the obligor compared to the fulfillment of another warranty claim.
b) The Buyer may request a proportionate reduction in the purchase price, may repair the defect themselves or have it repaired by a third party at the seller’s expense, or, as a last resort, may withdraw from the contract.
8.3 The Buyer is obligated to notify the Service Provider of the defect immediately upon its discovery, but no later than within 2 months of the defect’s discovery. The Buyer may not enforce its warranty rights beyond the 2-year statute of limitations period from the date of performance.
8.4 Within one year of delivery, the condition for asserting a warranty claim is that the Customer must prove that the product was sold by the Service Provider (e.g., a confirmation email).
8.5 For food products, warranty terms may be subject to special conditions depending on the nature and shelf life of the product—detailed information on these can be found on the product label and the product page.
9.1 The Customer may submit a complaint via email to berrivit@gmail.com or by mail to the Service Provider’s registered office (1013 Budapest, Pauler utca 11.).
9.2 The complaint must include:
a) the Customer’s name and contact information (email address or mailing address);
b) the product’s name and purchase price;
c) the date of purchase and the order ID;
d) a detailed description of the complaint;
e) the claim the Customer wishes to assert.
9.3 The Service Provider will investigate the complaint within 30 days and respond in writing. In the event of a rejection, the Service Provider will inform the Customer of the available legal remedies.
10. DISPUTE RESOLUTION, CONCILIATION BOARD, COMPETENT COURT
10.1 In the event of a legal dispute between the Parties, the Parties shall first attempt to resolve their differences amicably.
10.2 In the event of consumer disputes, the Buyer is entitled to turn to the Budapest Conciliation Board:

10.3 The Online Dispute Resolution (ODR) platform is operated by the European Commission: https://ec.europa.eu/consumers/odr
10.4 In the event of a consumer protection complaint, the Customer may also contact the Consumer Protection Department (National Consumer Protection Authority).
10.5 Disputes between the parties shall be adjudicated—subject to the rules of jurisdiction—by the Buda Central District Court or the Budapest Metropolitan Court, whichever has jurisdiction based on the Service Provider’s registered office.
11. LIMITATION OF LIABILITY
11.1 The Service Provider shall not be liable for any damages resulting from technical errors on the website, data loss, or the temporary unavailability of the website.
11.2 The Service Provider shall not be liable for any damages resulting from data incorrectly provided by the Customer.
11.3 The Service Provider shall not be liable for delivery delays or other performance impediments arising from circumstances beyond its control (force majeure). Force majeure includes, in particular, natural disasters, strikes, war, epidemics, and government measures.
11.4 The Service Provider’s liability—unless excluded by law—is limited to the purchase price of the ordered product(s).
12.1 The entire content of the website—including graphic elements, text, photographs, and other intellectual works—is the property of the Service Provider and is protected by copyright.
12.2 Any use, copying, distribution, or publication of the content is permitted only with the Service Provider’s prior written consent.
13. MISCELLANEOUS AND FINAL PROVISIONS
13.1 The Service Provider reserves the right to unilaterally amend these GTC. The amended provisions shall take effect on the date of their publication and shall apply to orders placed after such publication.
13.2 If any provision of these GTC is invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the applicable provisions of the relevant laws.
13.3 In matters not regulated by these GTC, the following laws shall apply:
– Act V of 2013 on the Civil Code (Ptk.)
– Act CVIII of 2001 on Electronic Commerce Services (Ekertv.)
– Act CLV of 1997 on Consumer Protection
– Government Decree No. 45/2014 (II. 26.) on the Detailed Rules Governing Contracts Between Consumers and Businesses
– EU Regulation 2016/679 (GDPR)
