1. SCOPE OF THE GENERAL TERMS AND CONDITIONS AND SUBJECT MATTER OF THE AGREEMENT
1.1 These General Terms and Conditions (hereinafter: GTC) apply to products sold in the online store operated by Dora Mihalik Einzelunternehmen (hereinafter: Service Provider) – specifically vegetable and fruit concentrates – and to sales contracts concluded between parties at a distance. The applicable law is Austrian law (ABGB, ECG, KSchG, UGB).
1.2 By submitting an order, the Customer accepts these terms and conditions and acknowledges them as binding.
1.3 The GTC are recorded exclusively in electronic form and may be downloaded and printed from the online store at any time. They do not constitute a written, signed contract.
1.4 By accepting the GTC, the Customer confirms that they are at least 18 years of age and have full legal capacity.
1.5 The contract is concluded exclusively in the Hungarian language. In the event of a legal dispute, the Hungarian-language text shall prevail.
1.6 These GTC are valid for an indefinite period. The Service Provider is entitled to amend them unilaterally; the amended terms and conditions shall apply to new orders from the date of their publication in the online store.
2. DATA PROCESSING
2.1 The Service Provider processes the Customer’s personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Austrian Data Protection Act (DSG), as well as the current Privacy Policy.

3. PRODUCTS, PRICES, PAYMENT
3.1 The products offered in the online store are vegetable and fruit concentrates, as well as product bundles composed of these. The product names, descriptions, and photos are listed on the product page. The photos are for illustrative purposes only and may differ slightly from the actual product.
3.2 Prices are quoted in euros (EUR) and include the value-added tax (Umsatzsteuer) required by law. Prices do not include shipping costs, except where the Service Provider offers free shipping (see Section 5.2). The Service Provider does not charge a separate packaging fee.
3.3 The Service Provider reserves the right to change prices. The price valid at the time of placing the order is binding on the Service Provider from the time of order confirmation.
3.4 The Customer may choose from the following payment methods:
- Online credit card payment (via the Stripe payment system, over an SSL-encrypted connection);
- Bank transfer (order processing is suspended until the amount is credited).
Payment data is processed by Stripe Inc. (354 Oyster Point Blvd, South San Francisco, CA 94080, USA). The Customer’s credit card information is not transmitted to the Service Provider.
4. THE ORDERING PROCESS AND FORMATION OF THE CONTRACT
4.1 The Customer adds the desired product(s) to the shopping cart in the online store, then enters their shipping and billing information on the online order form, selects a payment method, and submits the order.
4.2 By submitting the order, the Customer makes a binding offer to purchase. The contract is formed upon the Customer’s receipt of the Service Provider’s confirmation email.
4.3 The confirmation email includes:
- the description and quantity of the ordered products,
- the unit prices and the total amount,
- any shipping fees,
- the electronic invoice.
4.4 If the confirmation email is not received within 48 hours of submitting the order, the Customer is released from the obligation to accept the offer. Please also check your spam/junk mail folder.
4.5 The Service Provider reserves the right to reject an order without providing a reason (e.g., if the product is unavailable). In such cases, any payment already made will be refunded within 14 days.
5. SHIPPING AND DELIVERY
5.1 The Service Provider ships the ordered products to the delivery address provided by the Customer via GLS General Logistics Systems.
5.2 The shipping fee is displayed when the order is finalized. The Service Provider covers the shipping fee for orders exceeding a specified amount; the current threshold is published in the online store.
5.3 The expected delivery time, according to GLS’s delivery terms, is generally 2–5 business days from the date the package is shipped. The Service Provider assumes no liability for any deviation from this, provided it does not result from conduct attributable to the Service Provider.
5.4 The Service Provider shall not be liable for any delay or failed delivery resulting from incorrect, incomplete, or inaccurate delivery information provided. Any additional shipping costs resulting therefrom shall be borne by the Customer.
5.5 Upon receipt of the package, the Customer is obligated to inspect the integrity of the packaging. In the event of visible damage, the Customer is entitled to refuse acceptance and to notify the Service Provider thereof immediately.
6. RIGHT OF WITHDRAWAL FOR CONSUMERS (WIDERRUFSRECHT)
6.1 Under the Austrian Consumer Protection Act (KSchG) and Directive 2011/83/EU, the Customer—provided they qualify as a consumer (a natural person who enters into the contract for purposes other than business)—is entitled to withdraw from the contract without giving any reason within 14 calendar days of receiving the product.
6.2 The withdrawal period shall be calculated from the day on which the Buyer or a third party designated by the Buyer took delivery of the product. In the event of the delivery of multiple products at different times, the withdrawal period shall be calculated from the date of receipt of the last product.
6.3 The Buyer does not have the right of withdrawal for products that have been opened after receipt for health or hygiene reasons (KSchG § 18 Abs. 1 Z 10). The Service Provider will not accept returns of concentrates with opened or damaged packaging.
6.4 The Customer may exercise the right of withdrawal by means of a clear written statement, which must be sent to the email address dora.mihalik.at@gmail.com. The model withdrawal form attached to these GTC may be used, but its use is not mandatory.
6.5 The right of withdrawal shall be deemed to have been exercised within the time limit if the Buyer sends their statement before the expiration of the 14-day period.
6.6 In the event of a lawful withdrawal, the Customer is required to return the product—in its original, unopened, undamaged packaging—to the Service Provider no later than 14 days after sending the notice of withdrawal. The direct cost of the return shall be borne by the Customer.
6.7 The Service Provider shall process the refund no later than 14 days from receipt of the returned product, using the original payment method.
6.8 The Customer bears the burden of proving that they exercised their right of withdrawal in accordance with the provisions of this section.

7. WARRANTY AND CLAIMS (GEWÄHRLEISTUNG)
7.1 The Service Provider fulfills its warranty obligations in accordance with Austrian Civil Code (ABGB §§ 922–933).
7.2 In the event of a defective product, the Customer is entitled, in the first instance, to request repair or replacement (Verbesserung / Austausch); in the second instance—if repair or replacement is not possible or would entail a disproportionate burden—to request a price reduction or rescission (Preisminderung / Wandlung).
7.3 Natural spoilage of food products, deterioration in quality resulting from improper storage, and defects in products that have been handled contrary to their intended purpose are not covered by the warranty.
7.4 The Customer may submit a complaint via email to dora.mihalik.at@gmail.com. The complaint must include: the Customer’s name and contact information, the product name, the date of purchase, the order ID, a detailed description of the defect and—if possible—photographic documentation, as well as the claim to be asserted.
8. COMPLAINT HANDLING AND DISPUTE RESOLUTION
8.1 The Customer may submit a complaint to the email address dora.mihalik.at@gmail.com. The Service Provider will investigate the complaint within 30 days and respond in writing. In the event of a rejection, the Service Provider will inform the Customer of the available legal remedies.
8.2 Online Dispute Resolution (ODR): The European Commission maintains an online dispute resolution platform for the out-of-court settlement of consumer disputes. Accessible at: https://ec.europa.eu/consumers/odr/. The Service Provider’s email address: dora.mihalik.at@gmail.com.
9. LIMITATION OF LIABILITY (HAFTUNGSBESCHRÄNKUNG)
9.1 The Service Provider shall be liable without limitation for intentional acts and gross negligence (Vorsatz und grobe Fahrlässigkeit). The Service Provider is liable for damages resulting from slight negligence (leichte Fahrlässigkeit) only in the case of bodily injury. Liability for property damage or consequential damages in cases of slight negligence is excluded.
9.2 The Service Provider assumes no liability for technical errors in the online store, damages resulting from interruptions in the internet connection, or cyberattacks by third parties.
10. COPYRIGHT NOTICE
10.1 All content on the online store—including graphics, text, and photographs—is protected by the Service Provider’s copyright. Any use, reproduction, or distribution of this content in any form is permitted only with the Service Provider’s prior written consent.
11. GOVERNING LAW AND JURISDICTION
11.1 These General Terms and Conditions and any contracts concluded on the basis thereof shall be governed by Austrian law (ABGB, ECG, KSchG, UGB). The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
11.2 In the case of consumer contracts, jurisdiction is governed by the provisions of Section 14 of the Austrian KSchG, pursuant to which the consumer may also bring an action before the court having jurisdiction at the consumer’s place of residence.
11.3 In the case of disputes between businesses (B2B), the competent court is the court with jurisdiction in Vienna.
12. MISCELLANEOUS PROVISIONS
12.1 If any provision of these GTC is invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a legally valid provision that most closely approximates the intent of the invalid provision.
12.2 In matters not covered by these GTC, the provisions of Austrian law shall apply, in particular the relevant sections of the ABGB, ECG, KSchG, and UGB.
